The Court of Justice of the European Union has ruled that Google does not have automatic immunity from liability for certain videos published by commercial partners on the YouTube platform.
The case goes back to a dispute between Google and the Italian authorities, after a fine of 750,000 was imposed Euros on the company because of gambling-related ads that appeared on YouTube several years ago.
Google had argued that it was protected under European rules regarding the responsibility of Internet platforms for the content published by users, but the European Court refused to consider this. Protection is comprehensive in a disputed situation.
The case relates to video clips published by a content creator as part of a commercial relationship with Google, which included the promotion of online gambling services.
The ruling comes at a time when social media and video platforms are facing increasing pressure from the authorities Regulatory regulations regarding liability for content published on them, especially advertising and commercial content.
